Gift Card Purchase Terms & Conditions

These Gift Card Purchase Terms & Conditions apply to all Gift Cards purchased from Coles Group Limited through the Website.

Definitions

The following definitions apply to these Terms & Conditions.

Access PIN means the 4-digit Access PIN printed on the back of the Gift Card.

Card Number means the identification number that appears on the Gift Card.

Coles Group means Coles Group Limited ABN 11 004 089 936 of 800 Toorak Road, Hawthorn East, Victoria 3123.

Delivery Address means:

  1. for eGift Card, the email address as stated on the Order; and
  2. for plastic Gift Cards, the postal address as stated on the Order.

Delivery Fee means the fee payable for the delivery of the plastic Gift Card(s) to the Recipient as specified on the Website.

eGift Card means any electronic gift card issued by Coles Group that you have purchased through the Website for one or more of the Participating Retailers.

Expiry Date means the date specified on the Website for each Gift Card expiry which may vary for each Participating Retailer and each type of Gift Card, after which the Remaining Card Value on any Gift Card will not be available for redemption.

Gift Card means any plastic gift card or eGift Card issued by Coles Group that you have purchased through the Website for one or more of the Participating Retailers.

Gift Card Terms of Use means terms and conditions that apply to the use of the Gift Card which can be accessed at https://www.giftcards.com.au/CMS/Page/giftcardtermsofuse

Order means an order by you to purchase Gift Card(s) from Coles Group through the Website.

Participating Retailers means the retailers specified on the Website at which each of the Gift Cards can be used to purchase goods or services.

Personal Information includes, but is not limited to:

  1. your name, address, email address and payment details; and
  2. the name and address or email address (as applicable) of the Recipient.

Recipient means the individual (which may be you or another person) to whom the Order is to be delivered, as nominated by you in the Order.

Remaining Card Value means, at any time, that portion of the initial value loaded onto the Gift Card which is unspent and can be accessed by using the Gift Card in accordance with the Gift Card Terms of Use.

Website means www.giftcards.com.au or at such other address should the URL change.

A reference to we, us or our is a reference to Coles Group.

A reference to you or your is a reference to the purchaser of a Gift Card from the Website.

Agreeing to these Purchase Terms & Conditions

By purchasing a Gift Card you:

  1. agree to be bound by these Terms & Conditions; and
  2. warrant to us that you will comply with these Terms & Conditions and all applicable laws and that the Gift Card will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.

These Terms & Conditions apply in addition to the Gift Card Terms of Use.

Gift Cards

A minimum of $10 and a maximum of $500 can be loaded onto each Gift Card to a maximum Order value of $1000 excluding postage.
We may change at any time the minimum and maximum amounts that can be loaded onto a Gift Card at our sole discretion.

Payment

You agree to pay the nominated Gift Card value(s) in respect of each Order placed and any delivery fees (if applicable).

You may use Visa or MasterCard for payment of an Order. We do not accept other forms of payment for an Order. Payment must be cleared before Gift Cards are dispatched.

Delivery

Gift Cards are only available for delivery to and use within Australia. All Orders:

  1. for eGift Cards are delivered via email to the nominated email address specified in the Order; and
  2. for plastic Gift Cards are delivered via registered post to the nominated address specified in the Order. Gift Cards cannot be delivered to a PO Box or Locked Bag address.

Delivery of:

  1. eGift Card(s) to the nominated email address will take place within approximately 4 hours from the time payment is cleared; and
  2. plastic Gift Cards to the nominated address will take approximately 7-14 days.

Please allow additional time during peak Order periods such as Christmas. We do not accept responsibility for Orders which do not arrive within the period specified.

Delivery Fee applies for the delivery of plastic Gift Cards only. If an Order exceeds 10 Gift Cards, a Delivery Fee will be applied to each package of 10 Gift Cards. A maximum of 10 Gift Cards will be delivered in a single package.

We will not be responsible for any lost or misdirected Gift Cards, including where an incorrect address or email address has been provided to us.

Anyone with access to the nominated email delivery address who receives the eGift Card(s) will be presumed to be authorised to receive the eGift Card(s) on your behalf. We do not accept liability for any unauthorised acceptance and any consequential unauthorised redemption of an eGift Card.

Each plastic Gift Card sent to a different postal address attracts a separate Delivery Fee which cannot be bundled together.

A person must be at the Delivery Address to accept delivery of the plastic Gift Card(s). Anyone at the Delivery Address who receives the plastic Gift Card(s) will be presumed to be authorised to receive the plastic Gift Card(s) on your behalf. We accept no liability for unauthorised acceptance and any consequential unauthorised redemption of a plastic Gift Card. If there is no-one at the Delivery Address or no-one of the appropriate age to receive the plastic Gift Card(s) (or the person is unable or unwilling to provide appropriate proof of age), a calling card will be left for you to collect the plastic Gift Card(s) from the post office. We do not accept responsibility for late delivery or non-delivery due to incomplete or incorrect details provided. An Order must be accepted at the nominated delivery address within 30 days from the date it is dispatched. An Order will be returned back to us if it is not collected within 30 days from the date it is dispatched. Returned Orders may take up to14 days to be received by us.

Recipient

If you are giving a Gift Card to another person, you should ensure that the Recipient is aware of the Gift Card Terms of Use.

Refunds/Returns

Gift Cards cannot be exchanged for another denomination or tender (i.e. cash).

We are not responsible for and are unable to replace Gift Cards which are lost or stolen.

If you believe the Gift Card has been tampered with prior to receipt, you must contact us immediately. See clause 12 for contact details.

Gift Cards cannot be refunded or returned, unless required by law. Delivery Fees are non-refundable unless required by law.

Cancellations

Once submitted via the Website, Orders cannot be cancelled unless required by law.

We reserve the right to cancel an Order if it is:

  1. not accepted at the nominated Delivery Address within 30 days of dispatch date; or
  2. deemed by us to be fraudulent or possibly fraudulent.

Privacy

Personal information collected during the Order process will be used for the purpose of fulfilling the Order, and may be shared with a third party delivery agent and other parties necessary for the purposes of delivering your Order. You warrant that you have obtained the consent of all Recipients:

  1. for their personal information to be used by Coles Group and its service providers to prepare and deliver Gift Cards to the Recipients; and
  2. to receiving Gift Cards and associated communications from Coles Group and its service providers.

Risk & Title

Risk and title in the Gift Card(s) passes to you upon payment for the Gift Card(s). We will not be responsible for any lost or misdirected Gift Cards, including any eGift Cards lost or misdirected by email where it can be shown that the email was sent to the address set out in the Order. Nor will Coles Group be responsible for the unauthorised acceptance and any unauthorised redemption of a Gift Card by any person.

Applicable law

These Terms & Conditions are to be construed and enforced in accordance with the laws of Victoria, Australia.
